Supreme Court’s Strong Statement on POCSO Act

November 5, 2025: The Supreme Court of India has expressed deep concern over the rampant misuse of the Protection of Children from Sexual Offences (POCSO) Act. The court observed that the stringent law, enacted to shield minors from sexual exploitation, is increasingly being weaponized in marital disputes and consensual relationships between adolescents. The bench emphasized the urgent need to spread awareness among boys and men to ensure the law is applied correctly and not abused.

The remarks were made by a Division Bench of Justices Sanjiv Khanna and Surya Kant during the hearing of a case challenging an FIR registered under the POCSO Act on Tuesday. Issuing interim directions, the court stated, “The POCSO Act is meant to protect children, not to settle personal scores. In marital discord, it has become a tool for vengeance, and consensual relationships among teenagers are being criminalized.”

The observation stems from a petition filed on behalf of a 17-year-old boy who was in a relationship with a girl of similar age. The girl’s family rejected claims of consent and filed a POCSO case, leading to the boy’s arrest. The petitioner argued that the relationship was consensual and involved no coercion or exploitation. While acknowledging the need for thorough fact-checking in such cases, the bench stressed that preventing misuse of the law is equally critical.

The court further noted, “Emotional and physical attraction during adolescence is natural. Society and the law must recognize that not every consensual teenage relationship should be treated as a crime. Misuse of POCSO provisions is not only sending innocents to jail but also eroding the law’s credibility.”

Alarming Statistics: A Troubling Trend

Legal experts report that in the past five years, 20–25% of POCSO cases stem from marital disputes or family feuds. According to the National Crime Records Bureau’s (NCRB) 2024 report, complaints against boys under POCSO rose by 15%, with consent being a central issue in most cases. A study by child rights NGO CRY reveals that misuse is particularly rampant in rural areas, where false complaints are often filed under family pressure.

The Supreme Court directed the Union government to incorporate new awareness modules in POCSO training programs. It stated, “While girls’ empowerment is rightly prioritized, boys and men must also be educated about consent, legal boundaries, and the consequences of misuse.”

Expert Opinions: Awareness is the Key Solution

Renowned legal expert and former Attorney General Mukul Rohatgi welcomed the court’s balanced approach, saying, “The Supreme Court has struck a fair chord. The POCSO Act is vital, but its misuse is fueling gender-based bias. Gender-neutral education programs in schools and colleges are the need of the hour.”

Women’s rights activist Flavia Agnes cautioned that the statement should not dilute protections for genuine victims. She remarked, “The court intends to curb misuse, but we must ensure real cases of exploitation are not downplayed. Victim safety must remain the top priority in awareness drives.”

Government Response and the Road Ahead

The Ministry of Law and Justice responded promptly to the court’s directives, announcing plans to launch awareness campaigns in collaboration with the National Legal Services Authority (NALSA). These will include social media outreach, school curricula, and community programs. Pilot projects will be rolled out in high-incidence states like Uttar Pradesh, Bihar, and Rajasthan.

The Supreme Court has scheduled the next hearing for December 15, when the Centre will submit a detailed action plan. The bench reiterated that strengthening the POCSO Act while curbing its misuse is a pressing necessity to maintain justice and balance in society.

This landmark observation is set to spark debates in legal circles and broader society. Will it make the POCSO Act more effective, or mark a significant step toward gender equality? Only time will tell.
